State Appeals Kosilek's Sex Surgery Decision

Lawyers for the state have appeal the decision to allow Michelle Kosilek to have a sex survey, according to a report in the Boston Globe.

 

Lawyers for the Massachusetts Department of Correction's commissioner have asked to for a stay of order in the Michelle Kosilek's request for a state-paid sex change surgery, according to a report in the Boston Globe.

The state wants to hear from the Federal Court of Appeals on the case. According to the Boston Globe report, the state says Kosilek is receiving adequate care in prison and say the decision by federal judge Mark Wolf didn't address safety concerns for protecting Kosilek in prison when he issued the ruling to allow the surgery to take place.

Kosilek was known as Robert and living in Mansfield, when he was convicted of killing his wife, Cheryl, in 1990.
